HIV+ man denied compensation by greek court / Les déboires d'un séropositif grec licencié abusivement

The Areopagus, Greece’s highest court, has decided today to accept the partial annulment of a €7.539 fine that was imposed by the Court of Appeals against a clothing goods company as back wages and moral compensation to an HIV-positive man who was fired after his employers learned of his HIV status. The annulment was recommended by Justice Irini Athanasiou who was in charge of the case.

The company claims that the man was fired at the insistence of his colleagues who considered him a health risk. The fine had been imposed by two lower courts, the Court of First Instance and the Court of Appeals. They had both ruled that the man’s dismissal was abusive and unlawful under the greek Civil Code.

According to Justice Athanasiou however, the appelate court’s decision had to be partially overturned, effectively denying the man the right for moral compensation. According to the Justice the company cannot be held responsible for unlawful dismissal so moral compensation should be out of the question.

La Cour de Cassation grecque a décidé aujourd’hui d’annuler partiellement une amende de €7.539 qui avait été imposée par la Cour d’Appel contre une entreprise d’ habillement comme dommages et intérêts en faveur d’un homme séropositif qui avait été licencié alors que ses employeurs étaient au courant de son statut sérologique. L’annulation de l'amende avait été recommandée par le magistrat en charge du dossier, Mme Irini Athanasiou.

L’entreprise avait avancé que l’homme avait été licencié suite à la demande pressante de ses collègues qui le considéraient comme un risque pour leur propre santé. L’ amende avait été imposée par deux tribunaux : la Cour de la Première Instance et la Cour d’Appel. Elles avaient toutes deux décidé que le licenciement était abusif et illicite selon le Code Civil grec.

Mais, suivant l'avis de Mme Athanasiou, la décision de la Cour d’Appel a dû être partiellement renversée et l’obligation de l’entreprise accusée de dédommager l'homme pour préjudice moral a dû être abandonnée. Selon le magistrat, l’entreprise ne peut pas etre considérée responsable d’un licenciement illicite, et donc un dédommagement pour préjudice moral est hors de question.
